1. About Sommly

Sommly is operated by Sommly Ltd, a company registered in England and Wales (Company No. 17121707). Our registered address is 45 Church Road, Tiptree, Colchester, Essex, England, CO5 0SU.

Sommly is a platform that connects consumers with wine events run by independent businesses. We provide the technology for event discovery, ticketing, and payment processing. We are not the organiser of the events listed on our platform unless explicitly stated.

2. Using Sommly

By using Sommly you agree to these terms. If you do not agree, please do not use the platform. You must be at least 18 years old to create an account or purchase tickets.

You are responsible for keeping your account credentials secure. You must not share your account or use another person's account without their permission.

3. Ticket purchases and payments

When you purchase tickets on Sommly, you are entering into a contract with the event organiser, not with Sommly Ltd. We act as an intermediary to facilitate the transaction.

All payments are processed by Mollie B.V., a regulated payment service provider. When you proceed to checkout, you are redirected to Mollie's secure payment environment. Sommly does not store your card details or bank information.

Ticket prices are displayed in GBP and include any applicable fees:

  • Booking fee: A 2.5% booking fee is added to each order. This is clearly shown before you confirm your purchase.
  • Ticket price: Set by the event organiser. Sommly does not control ticket prices.

Payment is taken at the time of purchase. Once payment is confirmed, your tickets are delivered to your email address as a PDF with QR codes for check-in.

4. Refunds and cancellations

Refund policies are set by individual event organisers. If you need a refund, you can submit a request through Sommly and it will be forwarded to the organiser for review.

If an event is cancelled by the organiser, you are entitled to a full refund of the ticket price and booking fee.

Sommly is not liable for event cancellations, postponements, or changes made by organisers, except as required by law.

Sommly Buyer Protection. On top of your statutory rights, we offer a goodwill refund promise if an event does not take place or the organiser becomes uncontactable. See our Buyer Protection page for full details of what is covered and how to claim.

Credit card protection. If you paid by credit card and the total value of your order is between £100 and £30,000, Section 75 of the Consumer Credit Act 1974 may give you additional rights against your card issuer if the organiser fails to deliver the event or is in breach of contract. Contact your card provider for more information.

5. For event organisers

If you register as an event organiser, you agree to provide accurate information about your business, venues, and events. You are responsible for the events you list, including their content, pricing, and fulfilment.

To receive payments, you must connect a Mollie account via Mollie Connect (OAuth). Payments from ticket sales are routed directly to your Mollie account. Sommly deducts a platform application fee (approximately 2%) from each transaction. Mollie's own transaction fees also apply.

You are responsible for complying with all applicable laws, including consumer protection regulations, licensing requirements, and health and safety obligations for your events.

6. Content and intellectual property

All content on Sommly (design, text, graphics, logos, and software) is owned by Sommly Ltd or its licensors and is protected by copyright and other intellectual property laws.

Event organisers retain ownership of the content they submit (event descriptions, images, etc.) but grant Sommly a non-exclusive licence to display and promote that content on the platform and in marketing materials.

7. Acceptable use

You must not:

  • Use Sommly for any unlawful purpose
  • Submit false or misleading information
  • Attempt to gain unauthorised access to the platform or other users' accounts
  • Scrape, copy, or redistribute content from the platform without permission
  • Interfere with the operation or security of the platform

We reserve the right to suspend or terminate accounts that breach these terms.

8. Privacy

Your use of Sommly is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data, including our use of PostHog for analytics and Mollie for payment processing.

9. Limitation of liability

Sommly provides the platform on an "as is" basis. To the fullest extent permitted by law:

  • We do not guarantee that the platform will be available at all times or free from errors.
  • We are not liable for any loss or damage arising from your use of the platform, including losses related to event cancellations or changes by organisers.
  • Our total liability to you for any claim arising from these terms is limited to the amount you paid to Sommly (booking fees) in the 12 months before the claim.

Consumer statutory rights. If you are a consumer, nothing in these terms limits or excludes your statutory rights under UK consumer protection law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where a term in this agreement would reduce or exclude such rights, it does not apply to you.

Nothing in these terms excludes liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Complaints and dispute resolution

If you have a complaint about Sommly or an event booked through the platform, please contact us first at [email protected] so we can try to resolve it. We aim to respond within five working days.

If we are unable to resolve your complaint, you may be able to escalate it to an Alternative Dispute Resolution (ADR) provider. You can find information about approved ADR schemes through Citizens Advice or the UK government's consumer protection guidance. Use of an ADR scheme does not affect your right to take legal action.

11. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the platform. Continued use of Sommly after changes are published constitutes acceptance of the revised terms.
